Expert Legal Defense for Justified Actions in Houston

Understanding and protecting your right to self-defense is critical when facing legal challenges. At Restrepo Law, we specialize in representing individuals who acted to protect themselves or others in dangerous situations.

Stand your ground law in Texas provides the right to defend oneself, but asserting that right in court requires a nuanced understanding of the law and a detailed analysis of the facts. Our experienced attorneys will gather evidence, consult with experts, and craft a compelling argument to show that your actions were justified. With a compassionate approach and proven expertise, we stand by your side to fight for your freedom and future.

Self-Defense

  • Definition: The legal justification for using force to protect oneself from an immediate threat of unlawful force by another person. In Texas, this is outlined in Texas Penal Code § 9.31.

  • Penalties: If a claim of self-defense is accepted, it can serve as an affirmative defense, potentially leading to the dismissal of charges related to the use of force. However, misuse or unjustified claims can result in criminal charges, including assault or homicide, depending on the severity of the act.

Deadly Force

  • Definition: Force that is intended or known by the user to cause, or in the manner of its use is capable of causing, death or serious bodily injury. Texas law permits the use of deadly force under specific circumstances, as detailed in Texas Penal Code § 9.32.

  • Penalties: Justified use of deadly force can lead to acquittal of charges. Unjustified use may result in severe criminal charges, such as manslaughter or murder, with penalties ranging from imprisonment to capital punishment, depending on the case specifics.

Stand Your Ground

  • Definition: A law that permits individuals to use force, including deadly force, in self-defense without the obligation to retreat when they are in a place where they have a legal right to be. Texas incorporates this principle, as noted by Versus Texas.

  • Penalties: Proper invocation can lead to legal immunity. Improper use may result in criminal liability, with penalties depending on the nature of the offense.
